Terms and Policy for A Crochet Garden Experience Garden Club

Welcome to our garden club! By accessing our website, purchasing a membership, or using our services, you agree to be bound by these Terms and Policy. Please read them carefully.

1. Membership Plans:

• The Garden Club (Monthly Subscription): This membership provides you with ongoing access to our full library of patterns and tutorials, new monthly content, access to our community forum, and other member benefits as described on our website. Your subscription will automatically renew monthly until you cancel.
• The Pattern Lab (Lower-Priced Membership): This membership offers the same patterns as the "The Monthly Club"each month. However, this subscription does not include downloads, allowing you to create on a budget and not have to worry about hoarding patterns and taking up space. This subscription will automatically renew monthly until you cancel.
• Pay Per Bloom (Individual Pattern Purchase): This option allows you to purchase individual crochet flower patterns with a one-time fee, granting you permanent access to that specific pattern.

2. Payment and Billing:

• Subscription Fees: Monthly subscription fees for the Garden Club and the Pattern Lab are billed automatically to your chosen payment method on the same day each month.
• Payment Information: You agree to provide accurate and up-to-date payment information. You authorize us to charge the applicable membership fees to your payment method.
• Cancellations: You can cancel your monthly subscription at any time through your account settings on our website. Cancellations will take effect immediately, and  you will no longer have access to the membership content. No refunds will be provided for partial months.     
• Pay Per Bloom Purchases: Payment for individual patterns is processed at the time of purchase and is a one-time, non-refundable fee.
• Price Changes: We reserve the right to change our membership fees at any time. We will provide you with reasonable notice of any such changes.

3. Intellectual Property and Usage License:

• Ownership: All crochet patterns, tutorials, text, images, videos, and other content provided by The Garden Club are the intellectual property of Leticia Lebron and Flawless Crochet Flowers and are protected by copyright laws.
• Personal Use License: Upon purchasing a membership or an individual pattern, you are granted a non-exclusive, non-transferable license for personal, non-commercial use only. This means you can:
  • Access and view the content for your personal enjoyment and learning.
  • Download and print patterns for your personal use in creating physical items.
  • Share photos of the physical items you create based on our patterns on social media or with friends and family, provided you credit Leticia Lebron of Flawless Crochet Flowers as the designer.
• Commercial License (Separate Terms): As a member, you'll also be granted a commercial license
  • Commercial License Details: Our commercial license grants you the limited, non-exclusive, non-transferable right to sell physical items made from our patterns under specific terms and conditions, which may include:
    
    • Limitations on the quantity of items you can sell. 
    • Requirements for crediting Leticia Lebron as the designer in your product listings and marketing materials.
    • Restrictions on mass production or using our digital content for commercial purposes.
  • Unauthorized Commercial Use: Selling items made from our patterns without a valid commercial license is a violation of our intellectual property rights and is strictly prohibited.

4. User Conduct:

• You agree to use our website and services in a respectful and lawful manner.
• You are responsible for maintaining the confidentiality of your account information.
• You agree not to share your login credentials with others.
• You agree not to reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit our digital content (patterns, tutorials, etc.) for any commercial purpose without a valid commercial license.
• You agree not to engage in any conduct that could disrupt or harm our website or community.

5. Disclaimer of Warranties:

 Our website and services are provided on an "as is" and "as available" basis without any warranties,  express or implied, including but not limited to warranties of merchantability, fitness  for a particular purpose, or non-infringement.     

We do not warrant that our website or services will be uninterrupted, error-free, or  free of viruses or other harmful components.     

6. Limitation of Liability:

To the maximum extent permitted by law, Flawless Crochet Flowers and its affiliates, officers, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential,  or punitive damages (including, without limitation, loss of profits, data, use, goodwill, or other intangible losses)  arising out of or relating to your use of our website or services.     

Our total liability to you for any claim arising out of or relating to these Terms  and Policy or your use of our website or services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.      

7. Indemnification:

You agree to indemnify, defend, and hold harmless Flawless Crochet Flowers and its affiliates, officers, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including  reasonable attorneys' fees) arising out of or relating to your breach of these Terms and Policy or your use of our website or services.

These Terms and Policy shall be governed by and construed in accordance with the laws of The United States without regard to its conflict of law provisions.

 We reserve the right to modify these Terms and Policy at any time. We will notify you of any material changes by posting the updated Terms and Policy on our website or by other reasonable means. Your continued use of our website or services after the effective date of any changes constitutes your acceptance of the revised Terms and Policy.
